INFORMATION ON THE PROCESSING OF PERSONAL DATA.
TMCI Padovan S.p.A. as the owner of the personal data processing (hereinafter referred to as "Owner"), issues this information to the interested party in compliance with European and Italian regulations on the protection of personal data.
Purpose and legal basis of the processing
The Data Controller processes the data in order to adopt pre-contractual measures requested by the Data Subject, such as, for example, the sending of information on products or services (including brochure, catalogue and/or other company information material sending) or an offer, as well as to fulfil contractual and regulatory obligations connected with the business relationship and to pursue the legitimate interest in the correct management of the relationship itself, the verification of the solvency of the Data Subject and the management of any litigation.
The legal basis for processing, is the need to achieve the above-mentioned purposes.
Period of data retention
If information is requested, data will be processed for the time necessary to give feedback; if an offer is requested, however, the data will be processed for a maximum of twice the period of effectiveness of the proposal, without prejudice to further storage for the time necessary for the definition (however reached) of any disputes that may arise.
If the interested party becomes a customer of the Owner, the data will be processed for the entire duration of the business relationship and, subsequently, for the completion of any obligations related to or arising from the establishment of the same, for the period prescribed by law and according to the statute of limitations of the rights arising from the business relationship, without prejudice to further retention for the time necessary for the settlement (however reached) of any disputes that may arise.
Nature of data provision and consequences in case of refusal
The provision of data is necessary and therefore any refusal to provide them in whole or in part may make it impossible for the Owner to pursue the above purposes.
Categories of recipients
The Data Controller will not disseminate the data, but intends to communicate them to internal figures authorized to process them by virtue of their respective duties, as well as to commercial agents, credit institutions, credit insurance companies, credit recovery, commercial information, factoring, consultancy, business associations and/or organizations, professionals or service companies and public and private entities, also following inspections and checks.
Such recipients, should they process data on behalf of the Data Controller, will be appointed as data processors by contract or other legal act.
Data transfer to a third country and/or an international organization
Personal data will not be transferred either to non-European third countries or to international organizations.
Rights of interested parties
The interested party has the right to ask the Owner to access his/her personal data and to rectify them if they are inaccurate, to cancel them or limit their processing if the conditions are met, to oppose their processing for legitimate interests pursued by the Owner, as well as to obtain the portability of the data provided personally only if they are subject to automated processing based on consent or contract. The data subject also has the right to revoke the consent given for the processing purposes that require it, without prejudice to the lawfulness of the processing carried out up to the moment of revocation.
